Terms of service

As of: 14 July 2026

1. Scope and Contracting Party

1.1 These General Terms and Conditions apply to all orders placed by customers through the online shop at www.velvet-thread.de.

1.2 The customer’s contracting party is:

Home Design
Owner: Nils Hartmann
Eckenbacher Hardt 13
51588 Nümbrecht
Germany

Phone: +49 173 1638300
Email: info@velvet-thread.de

The online shop is operated under the Velvet Thread brand.

1.3 A customer is any natural or legal person who enters into a contract via the online shop.

1.4 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.5 A business customer is a natural or legal person or a partnership with legal capacity who, when entering into the contract, acts in the exercise of their trade, business or profession.

1.6 Any deviating terms and conditions of the customer shall become part of the contract only if Home Design has expressly agreed to their applicability.

2. Offer and Conclusion of Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract. It serves as an invitation to the customer to place an order.

2.2 The customer may initially place products in the shopping cart without obligation. Before submitting the order, the customer may review and correct the information entered.

2.3 By clicking the button used to complete the order with an obligation to pay, the customer submits a binding offer to purchase the products contained in the shopping cart.

2.4 After the order has been received, the customer will receive an automatic confirmation by email. This initially only confirms receipt of the order and does not constitute acceptance of the purchase offer unless the email expressly states that the offer has been accepted.

2.5 Home Design may accept the customer’s offer within five days by:

  • sending an explicit order or shipping confirmation by email,

  • dispatching or handing over the ordered goods,

  • requesting payment, or

  • initiating or carrying out the payment transaction.

The relevant time is the time at which the first of these events occurs.

2.6 If the offer is not accepted within the acceptance period, the customer is no longer bound by the order. Any payments already made will be refunded without undue delay.

2.7 The contract is concluded in the German language.

3. Products and Product Presentation

3.1 The characteristics of the goods are determined by the respective product description and the properties specified in the online shop.

3.2 Product images are used to illustrate the goods offered. Due to different screen settings, colours in particular may differ slightly from their actual appearance.

3.3 The customer’s statutory rights in respect of defects are not restricted by minor colour differences resulting from the way products are displayed. If the delivered goods differ materially from the agreed characteristics, the statutory rights in respect of defects apply.

4. Prices and Shipping Costs

4.1 All prices stated in the online shop are total prices in euros. They include all legally applicable price components and taxes.

4.2 Shipping costs may be charged in addition to the product price. The amount of the shipping costs is displayed to the customer in the online shop before the order is submitted.

4.3 The price displayed in the online shop at the time the order is placed applies to the order.

4.4 Discounts, promotional codes and special offers apply only subject to the respective stated conditions and within the specified promotional period.

5. Payment Terms

5.1 The payment methods currently available are displayed to the customer in the online shop and during the ordering process.

5.2 Unless otherwise stated for the respective payment method, the purchase price is due immediately upon conclusion of the contract.

5.3 If a payment service provider is used, its additional terms and conditions may apply. This does not affect the customer’s contractual obligations towards Home Design.

5.4 The customer may only set off claims if their counterclaim is undisputed, has been finally established by a court or is ready for decision. This restriction does not apply to counterclaims arising from the same contractual relationship.

5.5 The customer may exercise a right of retention only insofar as it is based on claims arising from the same contractual relationship. Any additional statutory rights of consumers remain unaffected.

6. Delivery

6.1 Delivery is available to the countries and regions that can be selected as delivery destinations during the ordering process.

6.2 Delivery is made to the delivery address provided by the customer during the ordering process.

6.3 The estimated delivery time is stated on the respective product page or during the ordering process.

6.4 In the case of advance payment, the delivery period begins on the day following the customer’s payment instruction. For other payment methods, the delivery period begins on the day following conclusion of the contract.

6.5 If the final day of the delivery period falls on a Saturday, Sunday or public holiday at the place of delivery, the delivery period ends on the next working day.

6.6 Partial deliveries are permitted insofar as they are reasonable for the customer. Partial deliveries do not result in additional shipping costs for the customer.

6.7 If an ordered product is exceptionally unavailable, Home Design will inform the customer without undue delay. If the order cannot be fulfilled as a result, any payments already received will be refunded without undue delay. The customer’s further statutory rights remain unaffected.

7. Transfer of Risk

7.1 In the case of consumers, the risk of accidental loss or accidental deterioration of the goods does not pass to the consumer until the goods are handed over to the consumer or to a recipient designated by the consumer.

7.2 If the consumer independently commissions a carrier that was not previously designated by Home Design, the risk passes when the goods are handed over to that carrier.

7.3 In the case of business customers, the risk passes when the goods are handed over to the carrier or other person appointed to carry out the shipment.

8. Retention of Title

8.1 The delivered goods remain the property of Home Design until the purchase price has been paid in full.

8.2 In the case of business customers, the goods remain the property of Home Design until all outstanding claims arising from the ongoing business relationship have been settled in full.

9. Right of Withdrawal

9.1 Consumers generally have a statutory right of withdrawal in the case of distance contracts.

9.2 Details regarding the requirements, deadlines, procedure and consequences of withdrawal are set out in the separate withdrawal policy and the model withdrawal form available in the online shop.

9.3 The statutory exceptions to the right of withdrawal remain unaffected.

9.4 The right of withdrawal exists independently of the statutory rights in respect of defects. Defective or incorrectly delivered goods therefore do not have to be reported under the right of withdrawal.

10. Statutory Rights in Respect of Defects

10.1 The statutory rights in respect of defects apply.

10.2 If the delivered goods are defective, the customer may, in accordance with the statutory provisions, in particular request subsequent performance. Where the statutory requirements are met, the customer may reduce the purchase price, withdraw from the contract or claim damages.

10.3 In the case of consumers, the statutory limitation period for claims relating to defects in new goods is generally two years from delivery of the goods.

10.4 Customers are requested to report goods with obvious transport damage to the carrier as soon as possible and to inform Home Design. Failure to make such a report does not affect the customer’s statutory rights.

10.5 Additional manufacturer warranties apply only if they are expressly stated for the respective product. Statutory rights in respect of defects are not restricted by any warranty.

11. Liability

11.1 Home Design shall have unlimited liability:

  • in cases of intent and gross negligence,

  • for damage arising from injury to life, body or health,

  • under the provisions of the German Product Liability Act,

  • in cases of fraudulent concealment of a defect,

  • where an express guarantee has been given, and

  • insofar as liability is mandatory by law.

11.2 In the event of a slightly negligent breach of a material contractual obligation, liability is limited to foreseeable damage typical for the contract.

Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the customer may ordinarily rely.

11.3 Liability is excluded in the event of a slightly negligent breach of other obligations.

11.4 The above limitations of liability apply accordingly for the benefit of Home Design’s legal representatives, employees and agents.

12. Customer Account

12.1 Where the online shop allows a customer account to be created, the customer is required to provide complete and accurate information during registration.

12.2 The customer is responsible for keeping their login details confidential and protecting them against access by unauthorised persons.

12.3 If there are specific indications of abusive or unlawful use of a customer account, Home Design may temporarily block access. The customer will be informed accordingly unless legal or security-related reasons prevent such notification.

13. Copyright and Rights of Use

13.1 The texts, images, photographs, graphics, logos, videos and other content used in the online shop may be protected by copyright or trademark law.

13.2 Any use, reproduction, editing or distribution of such content beyond the use permitted by law requires the prior consent of the respective rights holder.

14. Consumer Dispute Resolution

Home Design is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

15. Applicable Law

15.1 The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

15.2 In the case of consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence.

16. Place of Jurisdiction for Business Customers

If the customer is a merchant, a legal entity under public law or a special fund under public law, the registered office of Home Design shall be the place of jurisdiction for all disputes arising from the contractual relationship.

The statutory rules on jurisdiction apply to consumers.

17. Final Provisions

17.1 Individual agreements between Home Design and the customer take precedence over these General Terms and Conditions.

17.2 If any provision of these General Terms and Conditions is or becomes wholly or partially invalid, the remainder of the contract shall remain valid. The statutory provisions shall apply in place of the invalid provision.

17.3 The version of the General Terms and Conditions made available to the customer at the time the order is placed applies to the respective contract.
